1. Acceptance
By creating an account, accessing, or using EpsilonPAY, EpsilonPAY Merchant, EpsilonPAY POS, back-office tools, APIs, websites, or related services (collectively, the "Services"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
- You must be legally able to enter a binding agreement in your country.
- Financial, KYC, merchant, and POS features may require you to be at least 18 years old or the applicable age of majority.
- You must provide accurate information and keep it updated.
- We may refuse, suspend, or close accounts where required for risk, legal, fraud, sanctions, AML, or store-policy reasons.
3. Accounts and security
- You are responsible for your password, PIN, OTPs, linked devices, cards, QR codes, merchant staff access, and POS terminals.
- Do not share OTPs, passwords, PINs, staff credentials, NFC card PINs, or admin access.
- Notify us immediately if you suspect unauthorized access, loss of a linked card, a compromised terminal, or an incorrect transaction.
- We may require identity checks, phone or email verification, device checks, or additional review before allowing sensitive actions.
4. KYC, KYB, and compliance
EpsilonPAY may require personal identity verification, business verification, proof of address, source-of-funds information, sanctions screening, and ongoing monitoring. We may limit, delay, reverse, decline, or suspend transactions or accounts if verification is incomplete, inaccurate, suspicious, legally restricted, or required by a regulator, partner, court, payment provider, bank, or mobile-money operator.
5. Payments, cards, QR, NFC, and Palm Pay
- EpsilonPAY does not hold customer funds. Every payment is a direct debit from, or payout to, a linked Mobile Money account, card, or bank account. Your money stays with your provider; we keep the transaction records and receipts.
- Payments depend on available payment rails, limits, fees, provider availability, risk checks, and local law.
- Transaction histories, receipts, and settlement reports are service records. They show what happened; they are not money held by us.
- You authorize us and our providers to process the transactions you initiate or approve, including transfers, QR payments, NFC card payments, palm payments, refunds, fees, and reversals.
- Do not use EpsilonPAY cards, QR codes, NFC taps, or Palm Pay to get around authorization, limits, fees, verification, or risk controls.
- Palm Pay is optional. If you link your palm, you authorize us to create and use a palm template for payment authentication and fraud prevention, as described in the Privacy Policy.
- A transaction may be delayed, declined, reversed, frozen, or investigated for security, fraud, compliance, chargeback, technical, or provider reasons, or where information is missing.
Lending and borrowing (L&B)
The app includes tools that let users arrange lending between themselves. EpsilonPAY is not a lender, is not a party to any loan between users, does not guarantee repayment, and does not hold loan funds. The P2P Lending Terms shown in the app apply to these features, and lending disputes are handled through in-app support with your order ID.
6. Merchant and POS services
- Merchants are responsible for their products, prices, taxes, receipts, inventory, employees, customer records, refunds, voids, and terminal controls.
- Merchants must have all licenses, registrations, permissions, and tax compliance needed to sell their goods or services.
- Merchant staff and back-office permissions must be assigned only to authorized personnel.
- Merchants must not process fraudulent, illegal, high-risk, restricted, or unauthorized transactions.
- POS offline or delayed-sync features may be unavailable, incomplete, or subject to reconciliation once connectivity returns.
7. Fees, limits, and availability
Fees, limits, settlement timelines, and supported payment methods vary by account tier, merchant category, country, provider, and risk status. Any fee is shown to you before you confirm a transaction. We may change fees or limits, with notice where the law requires it. The Services can also be unavailable at times, for example during maintenance, provider downtime, or regulatory changes.
8. Prohibited use
You must not use the Services to:
- Break the law, evade sanctions, launder money, finance terrorism, commit fraud, or process stolen funds.
- Sell prohibited or restricted goods or services without authorization.
- Impersonate another person or business or submit false KYC, KYB, payment, or merchant data.
- Interfere with security controls, reverse engineer payment protections, abuse NFC/QR/Palm Pay flows, or attack the platform.
- Harass users or support staff, upload unlawful content, or misuse support channels.
- Create multiple accounts to bypass limits, fees, suspensions, or review.
9. Third-party services and app stores
The Services may integrate with Apple, Google, payment processors, banks, mobile-money operators, identity providers, cloud providers, SMS/email providers, push-notification providers, and other third parties. Their terms and privacy policies may apply. If you downloaded an app through Apple App Store or Google Play, their store terms also apply. Apple and Google are not responsible for providing EpsilonPAY customer support, except where their own rules or applicable law say otherwise.
10. Account closure and deletion
You may request account deletion in the app or through account-deletion.html. We keep records we are required to keep for financial, tax, AML, security, fraud, dispute, or other legal reasons. We may also close, restrict, or suspend accounts that violate these Terms or create risk.
11. Intellectual property
EpsilonPAY, Epsilon Nexus Ltd, the app designs, logos, software, documentation, content, and platform features are owned by Epsilon Nexus Ltd or its licensors. You receive a limited, revocable, non-transferable right to use the Services according to these Terms. You may not copy, resell, sublicense, or misuse the Services.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis to the maximum extent allowed by law. We do not promise uninterrupted availability, error-free operation, compatibility with every device, or availability of every payment rail, partner, country, or feature at all times.
13. Liability
To the maximum extent allowed by law, Epsilon Nexus Ltd is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, provider downtime, unauthorized use caused by your failure to protect credentials, or merchant-customer disputes. Nothing in these Terms excludes liability that cannot be excluded by law.
14. Disputes
If something goes wrong, contact support first so we can investigate. We may ask for the transaction reference, screenshots, receipts, identity verification, or records from the merchant, terminal, or provider involved. These Terms are governed by the laws of Ghana, unless mandatory consumer law in your country says otherwise.
15. Changes
We may update these Terms as the Services, providers, laws, or store requirements change. We will update the effective date and provide additional notice where required. Continued use after the effective date means you accept the updated Terms.
